The Union government has notified a fresh set of rules governing India’s civil aviation sector, replacing the nearly nine-decade-old Aircraft Rules, 1937. The new rules, called the Bharatiya Vayuyan Niyam 2026, will be notified by the Union Ministry of Civil Aviation. It will allow the Union Government to issue directions to airlines on fares if it considers intervention is necessary in extraordinary circumstances. Let’s take a look at the new airfare rules in India and how these can affect passenger travel.

Bharatiya Vayuyan Niyam 2026 To Replace Decades-Old Aircraft Rules, 1937
As per national news portals like AIR and DD India, the government has notified new rules empowering the Center to intervene in airline ticket pricing during extraordinary situations in the public interest. This development comes amid concerns over rising airfares driven by elevated crude oil and Aviation Turbine Fuel (ATF) prices.
Under the Bharatiya Vayuyan Niyam 2026, the government can issue written directions to airlines on fares – if it considers intervention is necessary in extraordinary circumstances. The directions must be proportionate to the situation and remain effective only for a specified period.

The Supreme Court had dismissed a public interest litigation seeking intervention into the “700 per cent increase in airfares”. According to Rule 192, airlines operating scheduled air services are required to determine fares based on factors such as operating costs and submit tariff details to the Directorate General of Civil Aviation (DGCA).

Greater Transparency In Airfare Pricing
The new airfare rules in India will also mandate greater transparency in airfare pricing. These rules will require airlines to publish their fares on official websites and other digital platforms. Airlines must display the total amount payable by passengers during the booking process and on tickets, along with a detailed price breakdown.
Moreover, they will also be required to clearly disclose cancellation charges and refund conditions so that passengers get to fully know the process. The DGCA will additionally continue to monitor tariffs set by scheduled airlines.

How Is The Newly Notified Framework Different?
India deregulated airline fare fixation in 1994, allowing carriers to determine ticket prices based on market conditions. The Civil Aviation Ministry has maintained that airfares are generally determined by demand, operating costs, and booking timelines.
Under the earlier Aircraft Rules, 1937, Rule 135 (4) empowered the DGCA to issue directions in cases involving excessive / predatory pricing and oligopolistic practices in the aviation sector. While Rule 192 of the newly notified framework retains provisions for monitoring airline tariffs, it doesn’t explicitly identify excessive / predatory pricing and oligopolistic practices in the aviation sector as grounds for government intervention.

However, it does grant the Union government powers to issue written directions on airline fares when “extraordinary circumstances” arise, subject to the conditions and limitations specified under the rules.
The Bharatiya Vayuyan Niyam, 2026 comprises 220 rules organized into eight chapters and six schedules. These cover aircraft registration, airworthiness, personnel licensing, aerodrome operations, air navigation services, and aircraft operations. They further lay down requirements for regulatory oversight, safety management, enforcement, and penalties, as per SMETimes.
